Privacy Notice for Clients and Prospective Clients
On behalf of INFINITI, with registered office in Puerto Rico, which engages in activities consisting of the sale and display of INFINITI brand vehicles, personal data from its Clients and Prospective Clients may be collected. Such data is treated as strictly confidential to protect your privacy and your right to informational self-determination.
I. Personal Data Collected
INFINITI only requests Personal Data necessary for the purposes described in this Privacy Notice, which is made known to Clients or Prospective Clients at the time they provide their Personal Data. The Personal Data collected includes primarily: name, address, phone number(s), email, and other contact details.
INFINITI may obtain Personal Data through the following mechanisms:
- Directly from you (Clients or Prospective Clients) or via third-party service providers contracted by INFINITI.
- Through its Authorized Dealer Network.
- When Clients or Prospective Clients visit INFINITI websites.
Clients and Prospective Clients may access INFINITI websites at any time without providing Personal Data.
However, to use certain features—such as details on new products and/or services, promotions, marketing campaigns, or customer satisfaction programs—users must register or enter their Personal Data. As part of this voluntary registration, INFINITI may request: name, address, phone numbers, email, and other data necessary for the operation of these services and/or promotions.
It is important to note that when Clients or Prospective Clients share Personal Data in public areas of INFINITI websites, such as chat rooms or bulletin boards, this data may be viewed and used by others without any responsibility on the part of INFINITI.
II. Purpose of the Information
A. For Clients:
INFINITI will use Clients’ Personal Data for the following purposes:
- to validate the warranty of their vehicle,
- to provide a product and/or service of the INFINITI brand,
- to inform about service campaigns if necessary,
- for after-sales and customer service activities,
- to carry out general marketing and promotional activities,
- to offer products, services, and information about the brand and its business partners,
- to perform statistical and market analyses,
- to keep records updated,
- to invite Clients to events and test drives,
- to inform about promotions and launches and maintain communication for ongoing business relations.
The primary purposes that give rise to the legal relationship are those in points (i)–(iv). Points (v)–(x) are not required to maintain the legal relationship.
B. For Prospective Clients:
INFINITI will use Prospective Clients’ Personal Data for the following purposes:
- to carry out general marketing and promotional activities,
- to offer products, services, and information about the brand and its business partners,
- to perform statistical and market analyses,
- to invite them to events and test drives,
- to inform about promotions and launches,
- to keep records updated and maintain communication for ongoing business relations.
The primary purposes for Prospective Clients’ information are marketing, advertising, and prospecting.
At any time, you may request to unsubscribe using the mechanisms detailed below.
III. Transfer of Personal Data
INFINITI may transfer Personal Data of Clients and Prospective Clients to all companies within the INFINITI Group worldwide. Additionally, it may transfer such data to third-party service providers with whom it has a legal relationship and/or to the Authorized Dealer Network.
INFINITI may also disclose Personal Data when required by law or to recognize, exercise, or defend a right in legal proceedings.
Personal Data may be processed both inside and outside Puerto Rico. In such cases, the processing will be subject to the applicable laws of the country where the data is transferred. As part of INFINITI’s growth, there may be occasions when INFINITI buys or sells business units. In such cases, INFINITI may transfer Personal Data to ensure continuity in services and product experience.
IV. Security of Personal Data
INFINITI is committed to safeguarding Clients’ and Prospective Clients’ Personal Data and has implemented physical, administrative, and technological security measures to protect against damage, loss, alteration, destruction, or unauthorized use, access, or processing. INFINITI also has information security policies and procedures, and its third-party service providers are committed to comply with them.
V. Exercise of ARCO Rights
Clients and Prospective Clients may exercise their ARCO Rights (Access, Rectification, Cancellation, and Opposition) regarding their Personal Data held by INFINITI.
To exercise ARCO Rights, the following must be included in the request:
- Full name of the data owner and contact details for receiving the response.
- Documents proving identity or legal representation.
- Clear description of the data for which the ARCO rights are being exercised.
- Any other element that facilitates the location of the data.
If submitted by someone other than the data owner, a power of attorney signed before two witnesses must be provided, along with copies of official IDs of both the data owner and the legal representative.
INFINITI will respond in accordance with Articles 28–35 of the Federal Law on Protection of Personal Data Held by Private Parties.
Clients and Prospective Clients may revoke consent granted to INFINITI for data processing at any time, as long as such data is not essential to maintain the legal relationship.
VI. Personal Data Obtained by Authorized Dealers
INFINITI works with its Authorized Dealers to comply with applicable data protection legislation. However, Authorized Dealers are independent legal entities, and INFINITI is not responsible for how they process Personal Data. Each time Clients or Prospective Clients provide data to an Authorized Dealer, the Dealer must provide a Privacy Notice stating their identity, address, purposes for data processing, and transfer of data to INFINITI, in accordance with applicable law.
VII. Use of Cookies
INFINITI informs you that its websites use “cookies” to automatically collect the following information:
- Date and time of website access.
- Daily number of visitors per section.
- Date and time of the user's last visit.
- Content preferences chosen during the first visit.
This information allows INFINITI to adapt and improve its services to user interests. Users may disable cookies in their browser if desired.
VIII. Changes to the Privacy Notice
INFINITI reserves the right to modify this Notice to adapt it to legislative, jurisprudential, or technological updates. In such cases, the most recent version will be available on www.infinitipr.com.
IX. Personal Data Department
INFINITI provides the Personal Data Department, responsible for receiving, registering, and handling requests to exercise ARCO Rights, limit data use or disclosure, and other rights under applicable law.
